General Terms & Conditions of Sale

Version 1.0 - January 2025. These terms govern any sale of artworks concluded between KAS Ventures SRL and a buyer.

Article 1 - Subject Matter

These terms and conditions apply to all sales of original artworks, numbered editions, photographic prints and digital works offered by Armature, whether through armature.art, the Artsy platform or any other authorised sales channel.

Article 2 - Prices

Prices are displayed in euros (€) inclusive of applicable taxes. Armature operates a total price transparency policy: no price is "on request". Prices may be updated at any time; the applicable price is that in force at the time of the order.

Article 3 - Order and Confirmation

Any order is firm upon receipt of payment or signature of a written agreement. Armature sends an order confirmation by email within 48 working hours. The sale is deemed concluded under Belgian law.

Article 4 - Payment

Payments are accepted by bank transfer (SEPA and international), credit/debit card (via Stripe) and selected cryptocurrencies. For orders above €5,000, an instalment payment plan may be agreed in writing. Late payments are subject to Belgian statutory penalties.

Article 5 - Delivery and Shipping

Artworks are dispatched from Brussels, Tunis or Dakar depending on their location. Indicative lead times are 5-15 working days within Europe, 10-30 days internationally. Shipping and insurance costs are borne by the Buyer unless otherwise stated. All artworks travel under nail-to-nail insurance cover. A delivery note and certificate of authenticity accompany each artwork.

Article 6 - Transfer of Ownership and Risk

Ownership of the artwork transfers to the Buyer upon receipt of full payment. Risk transfers upon handover to the carrier.

Article 7 - Right of Withdrawal

In accordance with the European Consumer Rights Directive (2011/83/EU) and the Belgian Code of Economic Law, a consumer Buyer (non-professional) has 14 calendar days from receipt of the artwork to exercise the right of withdrawal without justification. The artwork must be returned in its original condition, including original packaging. Return costs are borne by the Buyer.

This right does not apply to artworks made to specific order or personalised.

Article 8 - Authenticity Guarantee

Armature guarantees the authenticity of all artworks sold. A certificate of authenticity signed by the artist and/or Armature accompanies each artwork. In the event of a serious and documented challenge to authenticity within 5 years of the sale, Armature undertakes to take back the artwork and fully refund the Buyer.

Article 9 - Resale Right

In accordance with European Directive 2001/84/EC and its transposition into Belgian law, the artist resale right applies to resales of original works carried out with the involvement of an art market professional. Applicable rates apply. Armature handles collection and payment to the relevant collecting societies.

Article 10 - Intellectual Property

The sale of an artwork does not transfer copyright to the Buyer. The artist retains all moral and economic rights. The Buyer may display the artwork privately but may not reproduce, broadcast or exploit it commercially without written authorisation from the artist or their rights holders.

Article 11 - Disputes

In the event of a dispute, the parties undertake to seek an amicable resolution within 30 days. Failing that, the courts of Brussels have sole jurisdiction, under Belgian law.
